Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Curate My Plate ("Service"), you agree to comply with and be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Curate My Plate.

2. Description of Service

Curate My Plate provides an AI-powered meal planning platform. You acknowledge that the service utilizes Artificial Intelligence ("AI") to generate meal plans and recipes. While we strive for accuracy, AI-generated content may contain errors, omissions, or inaccuracies regarding ingredients, measurements, and nutritional data.

Curate My Plate provides a platform that helps users:

• Create personalized meal plans based on dietary preferences and restrictions
• Access a database of recipes and create custom recipes
• Generate grocery shopping lists
• Track pantry items and manage leftovers
• Utilize AI-powered recipe variations and meal planning tools
• Import recipes from external websites for personal meal planning and compile them into printable recipe packages
• Use the Plateoffs companion app to vote on recipes in bracket-style matchups and save winning recipes directly to their Curate My Plate account
• Use the Bento Basket companion app to manage grocery lists on iPhone and Apple Watch, and optionally sync them with household members via a CMP account

3. User Accounts

Account Registration

To use certain features of our Service, you must register for an account. By creating an account, you represent and warrant that you are at least 13 years of age. If you are between the ages of 13 and 18, you represent that you have reviewed these Terms with your parent or guardian. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

Account Deletion

You may permanently delete your account and all associated data at any time through Account Settings → Account Deletion within the app. Deletion is immediate and irreversible.

Account Termination by Us

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. Subscription Plans and Billing

Available Plans

We offer the following subscription tiers:

• Free Plan: Basic meal planning features at no cost
• Basic Plan ($5/month): Enhanced features with limited AI generations
• Advanced Plan ($10/month): Full access to all features with higher AI generation limits

Promotional Codes and Special Offers: From time to time, Curate My Plate may offer promotional codes or special discounts. These offers are subject to the specific terms and conditions stated at the time of the promotion. Promotional rates may be time-limited and may revert to standard pricing after a specified period.

Payment Terms

• Subscriptions are billed on your chosen interval (monthly or annual) in advance
• Payment is processed securely through Stripe or Apple In-App Purchase
• You authorize us to charge your payment method for all fees incurred
• All fees are non-refundable except as described in our Refund Policy

Payment Failure & Grace Period

If a renewal payment fails, your account will enter a grace period. You will be notified of the payment failure when you next open the app, and a 7-day grace period will begin from the time of that notification. During this period you retain full access to your paid features. If payment is not resolved within 7 days of notification, your account will be automatically downgraded to the Free plan. You can restore your subscription at any time by updating your payment method and resubscribing.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until the end of that period.

Apple App Store Subscriptions

For subscriptions purchased through the Apple App Store: payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your Apple ID Account Settings → Subscriptions. No cancellation of the current active subscription period is allowed during the active period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service without permission
• Reproduce, duplicate, copy, or resell any part of the Service
• Upload or transmit viruses or malicious code
• Collect or harvest information about other users
• Impersonate any person or entity

Rate Limiting and Fair Usage: To ensure the stability of the Service and to manage costs associated with AI generation, Curate My Plate employs rate-limiting and "Fair Use" thresholds. You agree not to exceed these limits through automated or manual means. We reserve the right, at our sole discretion, to temporarily or permanently throttle, suspend, or terminate access for any account that demonstrates usage patterns that significantly exceed typical individual use or that threaten the stability of our infrastructure.

6. Intellectual Property

Our Content & AI Output

All software, design, and original recipes provided by Curate My Plate are our exclusive property. While you are free to use, save, and export the meal plans and recipe variations generated by our AI for your personal use, the underlying AI models and the specific formatting of the Service remain the property of Curate My Plate and its licensors.

User-Curated Content

You may upload, save, or curate recipes and meal plans ("User Content"). You grant Curate My Plate a non-exclusive, royalty-free, worldwide license to host, store, and process this content (including through third-party AI providers) solely to provide and improve the Service for you.

Third-Party Recipes

When you import a recipe from a third-party website, the Service retrieves and stores recipe metadata, ingredients, and cooking instructions solely for your personal, non-commercial use — for example, to support meal planning, grocery list generation, and the creation of personal printable recipe packages. Imported content is stored privately within your account and is not indexed, made publicly searchable, shared with other users, or redistributed in any form.

All original recipe content — including instructions — remains the intellectual property of the third-party source and its author. A link to the original source is always preserved and displayed alongside any imported recipe. By importing a recipe, you confirm that your intended use is personal and non-commercial, and that you will comply with the source website's own terms of use.

Curate My Plate does not claim ownership over any third-party recipe content. We will promptly remove imported content upon receipt of a valid DMCA takedown request from the copyright holder.

Feedback: Any suggestions, ideas, or feedback you provide regarding Curate My Plate may be used by us without any obligation to compensate you.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• Nutritional information or meal plans will meet your specific health requirements

8. Health and Dietary Disclaimer

The meal plans, recipes, and nutritional information provided through our Service are for informational purposes only. You should:

• Consult with a healthcare provider before making significant dietary changes
• Verify all ingredients if you have allergies or dietary restrictions
• Not rely solely on our Service for medical nutrition therapy
• Use your own judgment regarding food safety and preparation

Third-Party Accuracy: We are not responsible for the accuracy or safety of recipes imported from third-party websites. While cooking instructions are imported for your personal convenience, you should always refer to the original source for the most current and complete version of the recipe, including any updates, corrections, or critical notes regarding cooking temperatures, food safety, and allergen warnings.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURATE MY PLATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Curate My Plate and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We may also update these Terms from time to time. Continued use of the Service after such changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in the Regional Municipality of Halton.

13. Apple App Store — Additional Terms

If you download or use Curate My Plate through the Apple App Store, the following additional terms apply:

• This agreement is between you and Curate My Plate only, and not with Apple Inc. Apple is not a party to these Terms and has no responsibility for the app or its content.
• The license granted to you is limited to a non-transferable right to use the app on Apple-branded devices that you own or control, subject to the Usage Rules in the Apple App Store Terms of Service.
• Curate My Plate, not Apple, is solely responsible for the app and its content. Apple has no obligation to provide any maintenance or support for the app.
• To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app. In the event the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no further warranty obligation beyond that refund.
• Curate My Plate, not Apple, is responsible for addressing any product liability claims, consumer protection claims, intellectual property infringement claims, or any other claims relating to the app or your use of it.
• If a third party claims the app or your use of it infringes their intellectual property rights, Curate My Plate, not Apple, is solely responsible for investigation, defence, settlement, and resolution of that claim.
• You must comply with any applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13. Bento Basket Companion App

Bento Basket is a free companion app to Curate My Plate for grocery list management on iPhone and Apple Watch. The following terms apply to your use of Bento Basket:

• Free to use: Bento Basket is provided free of charge with no in-app purchases. No account is required to use core features.
• Local data: When used without a CMP account, all grocery list data is stored locally on your device only. Curate My Plate has no access to this data.
• CMP account linking: Connecting your CMP account enables household syncing via Supabase. By connecting, you agree that your grocery list data will be stored and synced in accordance with our Privacy Policy and the same Terms that govern your CMP account.
• Household sharing: When you share a list with household members, all members can view and modify the shared list. You are responsible for the household members you invite.
• Apple Watch: The Bento Basket Apple Watch app is a companion to the iPhone app. It requires the iPhone app to be installed. Watch functionality depends on the WatchConnectivity session being active.
• Deeplinks to CMP: Tapping the recipe suggestion prompt passes your current item names to Curate My Plate via a device-local URL scheme. No data is sent over the network for this action.
• No warranties on grocery data: Bento Basket does not verify the accuracy of item names, quantities, or categories. You are responsible for verifying your grocery list before shopping.
